GENERAL CONDITIONS:
- I understand and agree that my participation in classes, demonstrations or events, or any program or service organized, operated, conducted and/or hosted by DIBADAE, ROSA LLABRES is conditional upon my execution of this agreement. In case of a person under 18 years old, the participation in the activities is conditional upon the execution of this agreement by the legal guardian.
- I am aware that fitness activities in general, and Pilates and Dance programs in specific involve the possibility of injury or death.
- I accept these risks voluntarily and all others arising from the classes and programs at or involving DIBADAE, ROSA LLABRES in any way, even if arising from the negligence, gross negligence, equipment failure or any other cause related to those associated in any way with DIBADAE, ROSA LLABRES, or classes and programs I may be involved in, the venues at which these events and programs take place, or by those organizing, officiating, instructing or participating in DIBADAE, ROSA LLABRES, and any classes, events and programs throughout the year, including the staff, instructors, volunteers and representatives (“the Releasees”)
- I understand that all instructions and rules for safe participation must be followed and that the SOLE RESPONSIBILITY FOR MY PERSONAL SAFETY REMAINS WITH ME, including my physical and emotional preparation and fitness to participate in workouts, events and classes which I chose throughout the year.
- I undertake and agree to remove myself from participation if I sense or observe any unusual hazard or unsafe condition, or if, at any time in any class or event I feel unable or unfit to continue for any reason.
- I give a FULL RELEASE AND WAIVER OF LIABILITY AND ALL CLAIMS that I have or may have in the future against the hosts and all other Releasees from all liability for any loss, damage, injury or expense that I may suffer as a result of my utilizing any part or parts of the DIBADAE, ROSA LLABRES classes or events held or hosted by DIBADAE, ROSA LLABRES or my presence at any venue at which they may take place due to any cause whatsoever including the forms of negligence set forth in paragraph 2 above or from any breach of contract or statutory duty or other duty of care including any duty of care owed under the relevant Occupier’s Liability Act on the part of the Releasees
- I AGREE NOT TO SUE, and I further agree TO INDEMNIFY AND SAVE HARMLESS the Releasees from all expenses, fees, liability or damage aware or cost of any type whatsoever arising from my participation in these classes or events.
TECHNICAL CONDITIONS :
- For online classes members should provide an internet connection with real speed of at least 2Mb/s to be able to assist to the classes. Any member has been advised to assist to a first free class in order to check that they can perform the class under optimal conditions.
CONDITIONS FOR DIBADAE, ROSA LLABRES:
- DIBADAE, ROSA LLABRES will provide to its clients the agreed services. The assistance and results of the same are exclusive responsibility of the client.
- DIBADAE, ROSA LLABRES will resolve any question that may arise related to the use of the service in the following email: info@dibadae.com.
MEMBERSHIP CONDITIONS :
- Memberships are individual, not being permitted to be transferred. Client is not allowed to sell, transfer or give the service rights to any other person. Memberships are not refundable.
- Only members with up to date payments will be allowed to the classes.
- DIBADAE, ROSA LLABRES reserves the rights to introduce new membership tiers or to change existing ones at any moment.
- DIBADAE, ROSA LLABRES will be in its right to terminate the relationship with any member without previous notice if:
1) The member represents any detriment for the interests of DIBADAE, ROSA LLABRES or any other members
2) The member is not up to date with membership payments.
OTHERS:
- DIBADAE, ROSA LLABRES reserves the rights to use individual or group photographs of members with promotional purposes. At the same time members fully release DIBADAE, ROSA LLABRES from any liability derived from the use of their image or testimony, renouncing to any future claim as a result of the use of any member name or image.
- DIBADAE, ROSA LLABRES reserves the rights to invite members to the classes at its solely discretion.
- DIBADAE, ROSA LLABRES reserves the rights to adjust the class schedule for various reasons, making every effort to advise members within reasonable time notice.
- All digital content, recorded, on demand classes or any other related material that the member will have access is property of DIBADAE and is not authorized to be shared or released to any other party. DIBADAE is a registered brand and all the content provided to the members is with its solely purpose of private use.
